Competition Details

Promoter

The Promoter is Royal Automobile Club of Victoria (RACV) Limited ABN 44 004 060 833 of Level 7, 485 Bourke Street, Melbourne Victoria, 3000.

Entry Restrictions

The competition is open to Year 9 to 12 students enrolled in Victorian Secondary Schools/ TAFE Colleges. An entrant can be an individual or group of individuals from one school.

Employees (and their immediate families) of the Promoter are ineligible to enter the competition. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

Competition Period

The competition commences at 9:00am on 29/01/2018 and closes at 11:59pm on 18/05/2018 (the “Competition Period”).

Eligibility/Entry Method

Judging Details

This is a game of skill and chance plays no part.

The first stage of Judging to determine the finalists will take place at 4:00pm on 30/05/2018 at RACV, 485 Bourke Street, Melbourne VIC 3000

The three entries that fulfil the competition entry criteria and are judged by the Promoter’s panel of judges to be the best entries based on originality, road safety merit and impact will be chosen as finalists and have their entries shown online via the RACV Young Driver Safety Facebook page and/or RACV YouTube channel.

The second stage of Judging to determine the winner will take place at 10:00am on 17/09/2018 at RACV, 485 Bourke Street, Melbourne VIC 3000.

The finalist whose entry is determined by the judges to have the highest online engagement based on the amount of Facebook “likes”, “shares”, “comments” and views will be awarded the First Prize.

The finalist whose entry is determined by the judges to have the second highest online engagement based on the amount of Facebook “likes”, “shares”, “comments” and views will be awarded the Second Prize.

The finalist whose entry is determined by the judges to have the highest online engagement based on the amount of Facebook “likes”, “shares”, “comments” and views will be awarded the Third Prize.

Winner Notification & Publication

The finalists will be notified by phone and/or in writing on [04/06/2018], and published on the RACV website (racv.com.au) for a period of 28 days. The winner(s) will be notified by phone and/or in writing on [21/09/2018], and published on the RACV website (racv.com.au) for a period of 28 days.

Prize Claim Date & Time

The prize must be claimed within 3 months of the draw date, or the prize will be deemed forfeited by the prize winner(s).

First Prize

$4,000

$2,000 cash for winning entrant plus $2,000 cash for their school. Prizes will be awarded per entrant, not per individual. An entrant can be an individual or group of individuals from one school.

Second Prize

$2,000

$1,000 cash for the entrant plus $1,000 cash for their school. Prizes will be awarded per entrant, not per individual. An entrant can be an individual or group of individuals from one school.

Third Prize

$1,000

$500 cash for the entrant plus $500 cash for their school. Prizes will be awarded per entrant, not per individual. An entrant can be an individual or group of individuals from one school.

Terms and Conditions

1.          Information on how to enter and prizes form part of these Terms and Conditions. Participation in this competition is deemed acceptance of these Terms and Conditions.

2.          This competition will be conducted during the Competition Period.

3.          The Prize(s) are stated as in the Prize Details.

4.          The winners will be chosen in accordance with the Judging details.

5.          Judging will take place in accordance with the Judging details at RACV, 485 Bourke Street, Melbourne VIC 3000.

6.          The winner will be notified in accordance with the Winner Notification & Publication section of these conditions.

7.          The Promoter may require the winner to provide proof of identity, proof of age and proof of residency. Identification considered suitable for verification is at the Promoter’s discretion.

8.          If a winning entry is not deemed to comply with these conditions of entry, the entry will be discarded and a new winner of that Prize will be determined by drawing a further valid entry in accordance with paragraph 4.

9.          The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, any person (including without limitation a winner) who tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these conditions, acts in a disruptive manner or acts with intent or effect of annoying, abusing, threatening or harassing any other person or behaves in a manner which may diminish the good name or reputation of the Promoter or any of its related bodies corporate or the agencies or companies associated with this competition, in contrary to law or is otherwise inappropriate.

10.        The Promoter's decision is final and binding, and no correspondence will be entered into

11.        The Prize is not transferable, changeable or exchangeable and cannot be redeemed for cash. The Promoter accepts no responsibility for any variation in prize value. If a Prize or any element of a Prize is unavailable for any reason, the Promoter may substitute for that Prize or element of that Prize another item of equal or higher value as determined by the Promoter, subject to the approval of the Victorian gambling authority if required.

12.        If the Prize has not been accepted or claimed in accordance with the Prize Claim Date & Time or if, after making all reasonable attempts, the Promoter cannot contact a winner (or the winner does not contact the Promoter) by the Prize Claim Date & Time, the relevant winner’s entry will be deemed forfeited. 

13.        By entering this promotion, each entrant accepts full responsibility for the decision to participate in the promotion and take the Prize should he/she be selected as a winner. The winner releases the Promoter, its related bodies corporate, affiliates, officers, agents, employees and suppliers (the “Released Parties”) from all liability, loss and damage of any kind arising out of or in connection with the acceptance of, and participation in, any prize. Without limiting the foregoing, the Released Parties will not be liable for any loss or damage whatsoever which is suffered (including but not limited to direct or consequential loss) or for any personal injury suffered or sustained in connection with the Prize(s) which cannot be excluded by law.

14.        Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage, loss or delay in transit to prize or be liable for any damage that occurs to the prize.

15.        The Promoter may communicate or advertise this competition using Facebook. However, the competition is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants are providing their information to the Promoter and not to Facebook.  Each entrant completely releases Facebook from any and all liability.

16.        If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated by due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law and subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion as appropriate.

17.        The Promoter is not liable for any tax implications arising from the prize winnings. Independent financial advice should be sought. Where this competition involves, for GST purposes, supplies being made for non-monetary consideration, entrants will follow the Australian Taxation Office’s stated view that were the parties are at arm’s length goods and services exchanged are of equal GST inclusive market values.

18.        Entrants consent to the Promoter using the entrant’s name, image and likeness in the event they are the winner (including photograph, filming and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including the outcome) and promoting any products manufactured, distributed, and/or supplied by the Promoter or its related companies.

19.        Entrants’ details may be used for future promotions carried out by the Promoter. Entrants can request not to receive information about future promotions by calling 13 RACV (13 7228) or unsubscribing from email communication.

20.        The personal information submitted in an entry is collected by the Promoter and will be used for the purpose of conducting the promotion. Personal information supplied by entrants may be provided to related bodies corporate or agencies of the Promoter and third parties involved in promoting or conducting the promotion and future marketing and publicity communications. An entrant can gain access to, update or correct any personal information held by the Promoter by contacting the Promoter by calling 13 RACV (13 7228). All personal information will be held at the office of the Promoter. A copy of the Promoter’s Privacy Charter in relation to the treatment of personal information collected may be obtained by contacting the Promoter or from www.racv.com.au.

21.        Entrants acknowledge that the Promoter may choose whether or not to publish the Entrant’s photograph or video on the RACV Young Driver Safety Facebook page, RACV YouTube Channel and or RACV website at its sole discretion. The publication of an entry to the RACV Young Driver Safety Facebook page, RACV YouTube Channel and or RACV website is for the purpose of public viewing and reference only and does not constitute acceptance of that entry as a winner, unless otherwise stipulated by the Promoter.

22.        Entrant’s consent to the Promoter modifying, reproducing, publishing and communicating their Entry Posts (in whole or in part) in any media for an unlimited period of time without remuneration for the purpose of promoting this competition (including the outcome) and promoting the RACV Road Safety programs, and the entrant agrees not to make any claim for payment, breach of copyright or breach of moral rights in such material.

23.        Entrants acknowledge and agree that they are responsible for obtaining all necessary rights for the public performance and communication of music arising from any use by either the Entrant or the Promoter of the video entry.

24.        Entrants acknowledge and agree that they are responsible for obtaining all necessary model and property releases for the use of any images, names, likenesses, trademarks, logos, uniforms, buildings signs, registered or copyright designs, or works of art depicted in the entry.

25.        Entrants agree that:

a.     with respect to all entries (and any other surrounding or supporting materials) submitted (“Content”) and unless the Promoter advises otherwise, the Entrants grant to the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable license to use, reproduce, modify, adapt, publish and display the Content for any purpose whatsoever and in any media, without compensation, restriction on use, attribution or liability, including in advertising and marketing campaigns. Entrants agree not to assert any moral rights in relation to such use. They warrant that they have the full authority to grant these rights.

b.     they are fully responsible for the Content they submit. Entrants acknowledge and agree that the Promoter, in its absolute discretion, may remove any Content from display at any time for any reason whatsoever, including but not limited to, where the Promoter reasonably suspects the Content does not comply with these Terms and Conditions. Notwithstanding the Promoter's right to remove any Content at any stage, the terms and warranties as set out in these Terms and Conditions will still apply to Content that is removed.

c.     the entry is made specifically for the competition and is not part of any other competition and has not been publicly shown previously in any other medium.

26.        Entrants warrant and agree that:

a.     they will not submit any Content that is unlawful or fraudulent, or that is in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication;

b.     they will only submit original Content that has been personally created by the Entrant;

c.     their Content does not contain viruses or cause injury or harm to any person or entity;

d.     if their Content depicts any person other than themselves, they have obtained their consent to submit the Content for the purposes of the competition; and

e.     they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computers or communication systems.
