Terms and Conditions for participation in RACV Show Your Card & Save®
(SYC&S) Program (The “Program”)
1. Participation in the Program
1.1. The Program is made available by Royal Automobile Club of Victoria (RACV) Limited ABN 44 004 060 833 (referred to in these terms and conditions as "RACV", "we", "our" or "us").
1.2. Participation in the Program is without additional charge and is only available to Members and Participants (referred to in these terms and conditions as "you" or "your") subject to these terms and conditions.
1.3. We may terminate your participation in the Program at any time if you:
a) fail to comply with these terms and conditions; or
b) supply any misleading information or make any misrepresentations to us or to any Program Partner in connection with the Program;
c) abuse any privilege accorded to you under the Program; or
d) cease to be a Member or a Participant.
2. Claiming a Benefit
2.1. The benefits which you can take advantage of are set out in the RACV Show Your Card & Save brochure, RACV website and as advertised from time to time.
2.2. In order to claim a benefit you must present your current RACV membership card or current membership card of an Australian Motoring Organisation or International Affiliate (“Card”) (or give details of such Card if you are making a transaction. The Program Partner will then swipe or scan the Card or enter the membership number on the Card into their systems and then transmit this data to RACV so that RACV can track the use of the Program (refer to condition 4.3 for more details). If you do not present your Card to the relevant Program Partner at the time of a transaction you cannot claim the benefit at the time of the transaction or at a later time.
2.3. Benefits under the Program cannot be sold, transferred or assigned.
2.4. RACV may:
a) change these terms and conditions at any time without prior notice to you;
b) change any of the benefits or the participating Program Partners;
c) suspend or terminate the Program at any time without prior notice.
2.5. All benefits are subject to availability and are subject to such other terms and conditions imposed by Program Partners as stipulated in the current RACV Show Your Card & Save brochure, RACV website, in any advertising or any special offer.
2.6. RACV takes reasonable care to ensure that information it publishes in relation to the Program is accurate but does not accept any liability for information provided by Program Partners or other third parties.
2.7. RACV and its Related Bodies Corporate are not liable to you for:
a) any failure by you to notify a Program Partner of a benefit available under the Program at the time of the transaction;
b) any qualifying transaction not being made available to you for any reason;
c) any failure by Program Partners to give a benefit to you under the Program as promised;
d) any loss or damage whatsoever (including indirect or consequential loss) caused by or arising out of any goods or services purchased under the Program from a Program Partner who is a third party (ie. not RACV or one of its Related Bodies Corporate);
e) any failure to notify you of any change in these terms and conditions, the RACV Show Your Card & Save brochure, participating Program Partners or qualifying goods and services;
f) the suspension or termination of the Program.
2.8. Program Partners do not have any authority, express or implied, to make any representations, warranties or statements on behalf of RACV.
2.9. Any tax payable on transactions under the Program is your responsibility, including any goods and services tax.
3. RACV Membership Card
3.1. RACV will issue a membership card to its Members upon which the SYC&S symbol appears (“RACV Card”). The RACV Card is not transferable and is the property of RACV.
3.2. You must return your RACV Card immediately if we ask you to. You must notify us immediately if your RACV Card is stolen.
3.3. We may terminate your use of the RACV Card without notice and for any reason, including if you:
a) do not comply with these terms and conditions;
b) do not comply with the conditions of any good or service hosted on the RACV Card;
c) cease to be a member of RACV.
3.4. If we terminate your use of the RACV Card,
you must return or destroy it as we direct.
3.5. We are not liable for any malfunction in the RACV Card or delay in replacing the RACV Card.
4.1. Information on how we handle your personal information is explained in RACV's Privacy Charter which you can obtain from any RACV shop or on the RACV website at www.racv.com.au
4.3. When you use your Card to claim a benefit, your membership number and information about your transactions may be collected by Program Partners on behalf of RACV and may be used by RACV for the following purposes:
a) the administration of the Program;
b) the provision of goods and services under the Program;
c) planning, research and marketing of the Program and goods and services of RACV and its Related Bodies Corporate.
4.4. The claiming of any benefit by you is not dependant on you providing your name and address to the Program Partner. However, you may need to give these details to a Program Partner if goods or services are to be delivered to you.
4.5. Program Partners will not have access to your name and address unless you agree to provide it to them. We take no responsibility for any information you may give to any Program Partner.
4.6. If you have opted-out of receiving marketing material from RACV, you will not receive any marketing material related to the Program. If you do not want to receive marketing material from RACV, please let us know by calling 13 RACV (13 7228).
